BCLI Issues Consultation Paper on New Probate Rules

The British Columbia Law Institute has issued a consultation paper on new rules of court dealing with probate business.  Entirely new probate rules are necessary as a result of the Wills, Estates and Succession Act passed in 2009.  They will need to be ready in time to come into force together with the Act.

The Consultation Paper on New Probate Rules contains annotated draft rules to replace Rules 21-4 and 21-5 of the Supreme Court Civil Rules.  A final version will be submitted to the Ministry of Attorney General and Supreme Court Rules Revision Committee
following review of the comments received on this Consultation Paper.  Comments are requested by 15 July 2010.
