Overview

This project examines legal issues that arose in the wake of the B.C. Court of Appeal’s decision in International Paper Industries Ltd. v. Top Line Industries Inc. This case considered section 73 of the Land Title Act, which outlines restrictions surrounding the subdivision of land into smaller parcels for the purpose of leasing or transferring the land. The court concluded that a lease executed in ignorance of section 73 must be considered void. The ruling was highly criticized and concern was expressed over the impact of the ruling on existing leases.
