Overview

This project revisits work done in the 1970s by the Law Reform Commission of British Columbia. It examines requirements imposed by statute or regulation to provide a sworn statement as part of an out of court transaction. The project classifies theses requirements using an eleven category classification system developed by the Law Reform Commission and makes recommendations for the replacement of specific requirements with a requirement to give an unsworn signed statement.

Keywords: affidavit, statutory declaration, sworn statements, unnecessary requirements in out of court setting, evidence, legislation and regulation, swearing, oath, courts & tribunals
