Session: Consent across the Continuum: Care Facility Admission, Health Care Treatment, and Restraint
Krista James with Alison Leaney, Provincial Coordinator, Vulnerable Adults, Community Response Services to Adults – Public Guardian and Trustee of British Columbia
Consent is foundational to any interaction with a patient or client. This interactive session will explore the legal requirements for consent in BC when a decision is required in different contexts, such as admission to a care facility, health care treatment, and use of a chemical or physical restraint.
Presenters will explain how various laws inter-relate and impact your practice, particularly the Health Care (Consent) and Care Facility (Admission) Act, the Residential Care Regulation, the Adult Guardianship Act, the Representation Agreement Act, and the Mental Health Act—including the newly proclaimed provisions on care facility admission and incapability assessment.
Participants will work with scenarios to explore the requirement to assist people living with dementia and other disabilities with communication and understanding, the role of supported decision-making in consent, when the Public Guardian and Trustee can get involved in decision-making, and other essential elements of consent in community, acute and long-term care.
