										<content:encoded><![CDATA[<p>A trust is a relationship in which a designated trustee holds title to assets for the benefit of a designated person called the beneficiary. A trust is typically established when an owner of property (called the <em>settlor</em>) transfers the property to a trustee on terms describing how the trustee is to administer the property to confer the benefits that the settlor intends. Rules of trust law requiring trustees to distinguish between returns on investment as either &#8220;income&#8221; or &#8220;capital,&#8221; sometimes result in trustees having to invest inefficiently. For trustees to obtain the maximum advantage for the trust, &#8220;total return&#8221; investment is necessary. This report considers whether trustees need to be freed from the requirement to select investments with regard to the legal category of the returns they will bring and to have the power to capitalize unspent returns. It is part of a broader project on modernization of the <em>Trustee Act</em>.</p>

<p>In 1995 British Columbia enacted the <em>Family Relations Act</em>, which provides for the assistance of plans in dividing pensions between spouses on marriage breakdown. In March 1996 a first edition of this publication was published to canvas the operation of the <em>Family Relations Act</em> and the <em>Pension Benefits Standards Act</em>, as these statutes apply when a marriage breaks down and one of the assets to be divided is a pension. Since publication of the first edition, a number of developments necessitated the publication of this second edition. This report is in the form of questions and answers. The material included is based upon questions that arose after Part 6 of the <em>Family Relations Act</em> was introduced in 1995.</p>
<p>An earlier report on the Division of Pensions on Marriage Breakdown was published by the Law Reform Commission of British Columbia in 1992. For a copy of the earlier report, <a href="/projects/division-pensions-marriage-breakdown-1992">click here</a>.</p>
<p>This subject was revisited in March 2013, leading to the publication of<em><a href="https://www.bcli.org/project/questions-and-answers-about-pension-division-breakdown-relationship-british-columbia"> Questions and Answers About Pension Division on the Breakdown of a Relationship in British Columbia</a>. </em>This was superseded on the completion of <a href="https://www.bcli.org/project/questions-and-answers-about-pension-division-on-the-breakdown-of-a-relationship-in-british-columbia-2015-2016">a revised version</a> in 2017.</p>
