</xml><![endif]-->The Ministry of Attorney General for British Columbia has released its White Paper on Family Relations Act Reform. The White Paper contemplates repealing British
Columbia’s main family-law statute, the Family Relations Act, and replacing it with a new act. The White Paper proposes far-reaching changes in many areas of family law. Included in it are proposals to implement recommendations found in four BCLI reports:

Report on the Parental Support Obligation in Section 90 of the Family Relations Act

Report on Pension Division on Marriage Breakdown: A Ten Year Review of Part 6 of the Family Relations Act

Report on Appointing a Guardian and Standby Guardianship

Report on the Need for Uniform Jurisdiction and Choice of Law Rules in Domestic
Property Proceedings.

The ministry is seeking comments on the White Paper. The comment period runs to 8 October 2010. To review a copy of the White Paper, please visit the consultations page on the Ministry of Attorney General website.

British Columbia's Ministry of Attorney General has released its
Family Relations Act Review: Report of Public Consultations. This
report summarizes the responses the ministry received during public
consultations on reform of the Family Relations Act held in 2007 and
2008. These consultations concerned comprehensive reform of most parts
of the province's main family law statute, addressing three BCLI
projects in the process. These projects concerned division of pensions
on marriage breakdown, parental support, and conflict of laws.

British Columbia’s Ministry of Attorney General has released its Family Relations Act Review: Report of Public Consultations. This report summarizes the responses the ministry received during public consultations on reform of the Family Relations Act held in 2007 and 2008.
The report notes that respondents “generally agree that it would be helpful to clarify and simplify the pension division provisions in the Act,” and “almost unanimously agree that the provision allowing parents to claim support from their adult children should be removed from the Family Relations Act” as recommended by the BCLI. In addition, “several respondents” support adoption of the Uniform Law Conference of Canada’s Uniform Jurisdiction and Choice of Law Rules in Domestic Property Proceedings Act, as recommended by the BCLI.
