Unnecessary Requirements for Sworn Statements

This project revisited work done in the 1970s by the Law Reform Commission of British Columbia. It examined requirements imposed by statute or regulation to provide a sworn statement as part of an out of court transaction. The project classified these requirements using an eleven category classification system developed by the Law Reform Commission and made recommendations for the replacement of specific requirements with a requirement to give an unsworn signed statement.

Keywords: affidavit, statutory declaration, sworn statements, unnecessary requirements in out of court setting, evidence, legislation and regulation, swearing, oath, courts & tribunals
