Honour of the Crown Project
Overview
The honour of the Crown is a constitutional standard to which the Crown is held in its dealings with Indigenous peoples. It informs the unique relationship between Crown and Indigenous peoples – the primary purpose being to uphold a mutual and respectful relationship. Within Canadian law, courts have largely applied the principle as informing Crown procedural obligations.
Legal principles analogous to honour and respect in relationships between sovereign peoples appear in many legal orders and systems of governance. This project explores how principles within Indigenous legal orders could inform legally plural understandings of honourable and respectful relationships between Crown and Indigenous peoples.
